BENEFITS FOR VA SPINA BIFIDA CLIENTS

Clients of the VA Spina Bifida Program are children of Vietnam vets suffering birth defects attributed by VA to their birth parent’s exposure to Agent Orange in the Vietnam war. There are thousands of such birth defect children of war vets recognized by VA.

Since 2008 a law has existed — SECTION 408 of Public Law 110-387, encoded in the US CODE OF FEDERAL REGULATIONS as 38 US 1803 — to provide ALL clients of the VA Spina Bifida Program with ……………………

…………………………………  with all encompassing comprehensive healthcare coverage with no exceptions.  Comprehensive means comprehensive. 

This care includes a VA SBP paid, state licensed social worker to act as the clients case manager. The case manager handles management of all healthcare for the client and protection of the clients legal rights and safety.  The case manager forwards any and ALL  healthcare bills to the Spina Bifida Program for payment.  The client pays no co-pays or deductibles.

This law also requires the VA Spina Bifida Program to provide all SBP clients with anywhere from six to 168 hours per week of in home Homemaker and Home Health Aide care as needed. The number of hours per week depending on the clients need as determined by their primary care physician. This HHHA care is for simple at home healthcare services, housekeeping and companionship.

The same law provides for  in home visiting nurse services and in home therapist visits for any sort of physical, speech, mental health or any other therapy needed by the client. All provided in the clients home and paid for by the VA SB Program.

I know about this VA Spina Bifida Program care, because my daughter is a client of  the VA Spina Bifida Program. My daughter was the first client of the VA Spina Bifida Program to receive any of the comprehensive healthcare benefits created by Congress in 2008. And my daughter CURRENTLY receives every VA SB Program benefit specified in the law.

The problem?

Ten years down the road from the passage of this law, my daughter remains the only client of the VA Spina Bifida Program to receive ANY of the comprehensive healthcare benefits created in 2008 for ALL of the VA Spina Bifida Program clients. None of the other thousands of VA Spina Bifida Program clients receive ANY of the benefits created in 2008 by SECTION 408 of Public Law 110-387 encoded in the US CODE OF FEDERAL REGULATIONS as 38 US 1803 .

Why after ten years is my daughter still the only VA Spina Bifida client receiving any of these 38 US 1803 benefits? There are a number of reasons. The VA Spina Bifida Program has kept these benefits a “secret” by refusing to do outreach to clients as ordered years ago by the VA Secretary. The employees of the VA Spina Bifida Program are poorly trained.  It is almost impossible to reach the VA Spina Bifida Program by phone.  And, when you do get through to them, no person in authority will accept phone calls from clients or their families. The VA Spina Bifida Program has created confusing in house rules, conflicting with the actual law, that bureaucratically baffle clients and their families.

And, worst of all, I have spoken with several VA Spina Bifida Program clients, who tried to access these benefits, but were told by VA Spina Bifida Program staff, that the benefits do not exist. And clearly, that’s not true, because my daughter receives them.

Perhaps YOU could ask Mr Jobes, why after ten long years, my daughter is still the ONLY  SB Program client receiving the comprehensive healthcare legislated in 2008?
